These Terms of Service (“Terms”) govern your access to and use of The Food Maestro website, mobile applications, and related services provided by The Food Maestro LLC (“The Food Maestro,” “we,” “us,” or “our”). By using the Service you agree to these Terms.

1. Use of the Website and Mobile App

You may use the Service only in accordance with these Terms and applicable law. You must be at least 13 years old (or the minimum age required in your jurisdiction).

2. Account Registration

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Provide accurate information and keep it up to date. Notify us promptly of any unauthorized use.

3. Subscriptions and Payments

Certain features require a paid subscription. Subscription fees, billing frequency, and renewal terms are disclosed at the point of purchase. Subscriptions automatically renew until cancelled.

4. Payment Processing

Payments, subscriptions, billing, renewals, cancellations, and refunds are processed through Stripe unless otherwise stated. Stripe’s terms govern its processing of your payment information. Refunds, where applicable, are handled by us in accordance with applicable law.

5. Chef Content and Recipe Experiences

The Service includes recipes, videos, written guidance, and other content produced by chefs and creators. This content is provided for informational and inspirational purposes. You are responsible for evaluating its suitability for your own circumstances, including any allergies or dietary restrictions.

6. AI-Generated Content and Recommendations

The Food Maestro may use artificial intelligence, machine learning technologies, automated recommendation systems, personalization tools, and user-defined preferences to generate recipes, meal plans, pantry suggestions, shopping recommendations, and other content.

AI-generated content may contain inaccuracies, omissions, or recommendations that are not appropriate for every user or circumstance. Users are responsible for reviewing and evaluating all recommendations before relying on them.

The Food Maestro does not guarantee the completeness, accuracy, nutritional suitability, or fitness of AI-generated content for any particular purpose.

7. User Responsibilities

You agree not to misuse the Service, including by attempting to gain unauthorized access, interfering with operation, scraping content without permission, or using the Service to violate the rights of others.

8. No Medical Advice

The Food Maestro provides food recommendations, educational content, and decision-support tools. It does not provide medical advice, diagnosis, treatment, or healthcare services. Information in the Service is not a substitute for professional medical advice. Always consult a qualified healthcare professional regarding any medical condition, dietary requirement, allergy, or treatment.

9. Allergies, Dietary Restrictions, and Food Safety

Users are solely responsible for verifying ingredients, allergen information, dietary compatibility, food safety considerations, and overall suitability before purchasing, preparing, or consuming any recommended food, ingredient, recipe, meal plan, or product.

While the Service may incorporate user-provided preferences, dietary restrictions, ingredient exclusions, and personalization settings, The Food Maestro cannot guarantee that recommendations will be free from allergens, cross-contamination risks, dietary conflicts, or ingredients unsuitable for a user’s individual circumstances.

Users with food allergies, medical conditions, dietary restrictions, or other health concerns should independently verify all recommendations and consult qualified professionals when appropriate.

10. Beta Features and Early Access Programs

Certain features, functionality, integrations, chef channels, recommendation systems, or services may be designated as beta, pilot, preview, testing, or early-access features.

Such features may contain bugs, errors, inaccuracies, interruptions, or incomplete functionality and are provided on an “as-is” basis without warranties of any kind.

Participation in beta or early-access programs is voluntary and at the user’s own risk.

11. Third-Party Chef and Creator Content

The Service may include recipes, recommendations, videos, educational materials, and other content created by independent chefs, creators, partners, healthcare professionals, or third parties.

The views, opinions, recommendations, and content expressed by such contributors are their own and do not necessarily represent those of The Food Maestro.

The Food Maestro is not responsible for the accuracy, completeness, or suitability of third-party content.

12. Service Availability

The Food Maestro may modify, suspend, discontinue, update, or remove any portion of the Service, features, content, chef channels, or functionality at any time without notice.

We do not guarantee that the Service will be available at all times or free from interruptions, delays, errors, or technical issues.

13. User Content

Users retain ownership of content they submit to the Service.

By submitting content, including profile information, recipes, photos, comments, feedback, suggestions, pantry information, or other materials, users grant The Food Maestro a non-exclusive, worldwide, royalty-free license to host, process, display, reproduce, and use such content solely as necessary to operate, improve, and provide the Service.

Users represent that they possess all rights necessary to submit such content.

14. Intellectual Property

The Service, including software, design, text, graphics, logos, chef content, and recipes provided by us or our partners, is owned by The Food Maestro or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

15. Acceptable Use

You may not (a) copy, modify, distribute, sell, or lease any part of the Service; (b) reverse engineer or attempt to extract source code; (c) use the Service to send spam or harmful content; or (d) use the Service in violation of law.

16. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, to the maximum extent permitted by law.

17. Limitation of Liability

To the maximum extent permitted by law, The Food Maestro and its affiliates, officers, employees, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service. Our aggregate liability for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the claim, or USD $100, whichever is greater.

18. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. You may delete your account as described on our Account Deletion page.

19. Changes to the Service

We may modify, suspend, or discontinue features of the Service at any time. We may also update these Terms; material changes will be communicated through the app or by email.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law principles, except where mandatory consumer protection laws require otherwise.

21. Dispute Resolution and Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through final and binding arbitration rather than in court, except where prohibited by applicable law.

Arbitration shall be conducted in San Diego County, California, under the rules of the American Arbitration Association or a comparable arbitration provider.

To the fullest extent permitted by law, each party waives the right to a trial by jury.

22. Class Action Waiver

To the fullest extent permitted by law, disputes must be brought on an individual basis and not as a plaintiff or class member in any purported class action, collective action, representative action, or consolidated proceeding.

Users expressly waive any right to participate in class actions or class-wide arbitration.
